Good news. The electronic wills and remote notarization bill died again this year. (For more details, see last year’s comments.) https://cramerlawcenter.com/areas-of-practice/florida-electronic-wills-act/. The Florida Bar’s Elder Law Section is continuing to work with legislators to try to come up with a bill that contains adequate protections against exploitation of Florida citizens, or else continue to fight it. I still think it is just a bad idea. Stay tuned.

The number of seniors (Americans aged 65 or older) who drive is on the rise.  In fact, from 1999 to 2009, statistics show a 20% increase in senior drivers.  The AAA Foundation for Traffic Safety predicts that this trend will continue; seniors will make up 25% of the drivers on the road by 2025 and there will be at least 60 million senior drivers by 2030.

WILL YOU HAVE TO PAY YOUR PARENT’S NURSING HOME BILL?

     A majority of states now have laws (called filial responsibility laws) that require adult children to financially support their parents.  These laws make children responsible for providing basic necessities, such as food, shelter, and medical care, to parents who cannot afford them.  Historically, enforcement of these laws has been rare, but changes to Medicaid laws and a recent Pennsylvania court case may encourage nursing homes to make use of filial responsibility laws or lobby for their enactment.

BEWARE OF SCAMS TARGETING THE ELDERLY

As estate planning and elder law attorneys, one of our primary goals is to educate our clients and community about how they can protect themselves and their assets. This newsletter will share and expand upon a recent article about con artists who target senior citizens. The Associated Press reports that “elder financial abuse” has become an “industry” that brings in billions of dollars each year. This form of elder abuse includes fraud perpetrated by relatives and acquaintances as well as scams run by complete strangers. The outsider-run cons can be particularly devastating, both financially and emotionally, because they are so effectively targeted at older individuals and very difficult to trace back to their often international origins.
